A. WHY ?
Because we need to know what we can properly expect of you and you need to know
what you can properly expect of us.
B. WHO ?
In these conditions :
1. "We" and "us" means the Henorita and Senor Stag web pages and business
operated by GJR Events Abroad Limited. The registered office is 19 Church Road, Fleet Hampshire. BN3 6HP. (Company No. 04108175)
2. "You" means the person who has completed the personal booking form and
each and every member of the group on whose behalf that person has booked with
us.
C. WHAT ?
We organise hen, stag and corporate events and weekends in Spain. In these
conditions
"event" means any activity or event participated in by you, or any accommodation
you stay in, and organised by us.
D. WHERE ?
We organise hen, stag and corporate events and weekends in various locations
and cities in Spain. In these conditions "destination" means the place or location
where you have booked your event with us. You can currently book the following
destinations with us : Barcelona, Benalmadena, Benidorm, Madrid, Malaga,
Palma, Puerto Banus, Seville and Valencia.
E. WHAT DO YOU AGREE TO DO ?
1. To behave at all times in a safe and courteous manner.
2. To obey the proper instructions of any supervisor, activity leader or
guide.
3. To dress and equip yourself suitably for any event when we indicate prior
to the event that special clothing or equipment is to be provided by you.
4. To use safety equipment as instructed and not tamper with or abuse it.
5. To compensate us or our contractors for any damage caused by you in the
course of an event.
6. Each member of the group is responsible for their own individual behaviour;
any behaviour deemed unacceptable is not the responsibility of us or the
person who made the booking with us (normally the best person) on their behalf.
F. HOW DO WE DEAL WITH RISK ?
We organise a number of events. Some of them involve a degree of risk to
you of physical injury or damage to property. This is what makes these events
exciting. We do not exclude our liability for death or personal injury caused
by our negligence or that of our employees but we do not accept liability
for the negligence of any other persons. We do all we reasonably can to reduce
the risk to you. If we have done that and are not negligent, you will take
responsibility for any risks involved in participation in any event.
In order to reduce risk and provide cover if injury occurs, the following
conditions will apply :
1. We reserve the right to withdraw you from an event if you do not honour
your obligations under Clause E of these conditions or if, in our opinion,
you are not sufficiently fit to participate in any event or if you are under
eighteen. You must let us know of any existing medical condition which may
affect your ability to participate fully in an event.
2. We want you to arrange accident cover for you when you attend an event.
We think this is important. Information is provided on the
Henorita and Senor Stag web-sites where to find suitable insurance. We are
entitled to assume that either you have arranged your own cover or you are
prepared to take the risk of being uninsured. Insurance cover will be subject
to the policy conditions and any exemptions or excesses mentioned in the policy.
3. Occasionally, we or our suppliers may (because of the risky nature of
an event) require you to sign a disclaimer releasing us or them from liability
for loss suffered in the course of an event. We will not be liable for any
loss you may suffer if you fail to sign such disclaimer, whether such loss
occurs under this agreement or otherwise.
G. WHAT HAPPENS IF YOU WANT TO CANCEL ?
Cancellation costs us money and there needs to be an agreed cancellation
policy. We and you agree the following :
1. Any cancellation must be sent by e-mail by the Organiser (you) to the person
in our company (us) responsible for your booking.
2. You may cancel within 7
days of us receiving your deposit without reason*. In this case, we will return
your deposit within 30 days of receiving your cancellation. However, we will
not return deposits paid within 14 days of your arrival date.
3. Depending on
the date of cancellation, you must pay the following cancellation charge :

4. If you wish to cancel on behalf of only some members of the group then the
cancellation charges outlined above will apply pro rata but we may become
entitled to cancel the event (see below), and the group discounts may no
longer apply. This may necessitate a further payment by you to pay the difference
between the previous discounted price and the revised price.
* The 50% deposit required for yacht hire is non returnable. Booking will only be made upon receipt of the deposit. If adverse weather conditions make it impossible to sail and we can not reschedule the event, a complete refund will be issued.
H. WHAT IF WE CANCEL ?
1. In most cases neither we nor you are entitled to cancel because of adverse
weather conditions. For some events if the safety risks are, in our discretion
or our suppliers´discretion, unacceptable, we reserve the right to cancel
the event. If we do cancel in such circumstances, we will make every effort
to reschedule the event for another date. We will not be obliged to give
any refund if we cancel an event because of adverse weather conditions. This
will also apply to any rescheduled event.
2. Unless we cancel in the circumstances
described above, we will only cancel if :
a) For reasons beyond our control, we cannot organise the event or the proposed
venue because the event is unavailable.
b) You or we become insolvent or in the case of an individual you become
subject to a bankruptcy petition.
c) We believe that the booking, any of those associated with it, or the purpose
of the booking might damage our reputation.
d) We decide that any reduction in numbers from the original booking makes
the event uneconomical or impractical.
3. Unless we cancel because of safety
risks associated with the weather (when we will reschedule) or because of
a reduction in numbers (when a cancellation charge may apply), if we cancel
we will refund all advance payments made by you and we will not have any further
liability to you.
4. In the event of loss or
damage suffered by you or changes
to or cancellation of the whole
or part of the program due
to reasons of unusual or unforeseeable
circumstances beyond Henorita's
or our suppliers' control compensation
will not be payable.
I. WHAT ABOUT MONEY ?
1. For hotel bookings a deposit
of 25% of the value of the accommodation
is required to at the time of
booking.
2. For yacht hire a 50% deposit
is required at the time of booking.
3. For all activities or football tickets a £50
deposit is required unless otherwise
specified at the time of booking.
4. The remainder of the total
booking value, including accommodation
and activities, is payable no
later than five weeks before
the scheduled event.
5. We hold all monies pre-paid
by you in a separate bank account
until the event has taken place
or the cancellation policy applies.
This is in accordance with the
Package Travel Regulations 1992.
6. For apartment accommodation
please also refer to Section
L.
7. We accept payment by cheque, bank transfer and all major credit and debit cards. We do not apply surcharges to payment by credit or debit card.
J. WHAT ABOUT BOOKING LAST MINUTE ?
We do endeavour to take last minute bookings until 3 days before your expected
arrival date. However, you must understand that only certain activities and
tickets are available, and that accommodation is also very difficult to secure.
If you are paying less than 7 days before your arrival date, you must pay by
credit card. No other method of payment will be acceptable.
If we have not received full payment by the time you have arrived in Spain,
we reserve the right to cancel your booking and apply the cancellation charges
above.
K. FOOTBALL TICKET BOOKINGS
If you have booked football tickets as part of your package with us, you should
be aware of the following. No tickets can be obtained for a Spanish La Liga home game until 5 days before the game. We will always endeavour
to buy the tickets on the Monday, and we have so far never had problems buying
tickets. However, in the unlikely event that tickets are unavailable or sold
out, we reserve the right to refund you the money you paid us for the football
tickets as part of the package. We will inform you of this as soon as possible,
and will refund you by bank transfer in British pounds, as soon as we receive
your bank details. Another option is to use the refund to help pay for an alternative
activity that we offer. Depending on the activity, we can usually book these
at relatively short notice.
Seating areas are indicative. The stadium seating areas are sometimes divided
up differently. This is a situation which is out of GJR Events Abroad Limited´s
control, as division of seating areas is decided by the club, depending
on the match and allocation of tickets to their season ticket holders.
We always endeavour to provide the tickets you order from us. However,
due to the factors above, we may provide tickets of the same value but in a
different area to originally specified. We always endeavour to provide tickets
that ensure all members of a group will be seated together. Due to the high
demand at certain games, however, this may not always be possible.
Please be aware that the face value printed on the tickets you receive does
not reflect the price you pay (or even the price we pay !) for the tickets.
Due to the popularity of most games, we can not source the majority of tickets
directly (especially large blocks of tickets), and therefore pay more for using
other sources.
L. APARTMENT ACCOMMODATION
If you have booked apartment accommodation with us, you agree to abide by the House Rules. We charge a £20 returnable deposit per person for groups staying in apartment accommodation. The total deposit covers the complete group, and does not apply to individuals.
To fulfill our legal obligations we will also require one passport per apartment (2 passports for larger apartments) to be presented on arrival at the apartment/s. These will be kept safely for the duration of your stay and returned when you check out of the apartments.
If you abide by the House Rules, no damages are reported after your stay, and no excessive cleaning is needed to return the apartments to the condition you entered them, we will return your deposit the week after your return from Spain.
If any of the House Rules are broken, damage is reported or excessive cleaning is required, we will withhold all or part of your group's deposit to pay for cleaning, expenses, damage and our time rectifying the problems you have caused. If there is a partial refund, we will refund this in the same way as for a full refund.
You can choose to have your deposit returned by credit card if
you paid by this method originally, or by bank transfer to UK bank accounts.
If you choose to have your deposit returned by other means, this may incur a
charge which will be taken from the returned deposit amount.
AGREEMENT
We think that the above terms and conditions are fair. They are governed by
the law of England and Wales. They do not affect your consumer statutory rights.
You will need to indicate your agreement on your Personal Booking Form so that
we know you have understood and agreed to our terms and conditions.
